Terms of Use

These terms are an agreement between you and North Pattern LLC, a Wyoming limited liability company (“we”, “us”, “our”), which runs the TallPlan app for iPhone and Android and the tallplan.app website (together, “TallPlan”). By downloading or using TallPlan, you agree to them. If you don’t agree, please don’t use it.

Who can use TallPlan

  • 13 and older: you can use TallPlan yourself. If you’re under the age of majority where you live (18 in most places), a parent or guardian must agree to these terms, and to any subscription, on your behalf. By using TallPlan you confirm they have.
  • Under 13: you can’t use TallPlan on your own. The app asks a parent or guardian to set it up, and from then on the parent is the user and enters information about their child.

A parent or guardian who agrees for a child, or uses TallPlan for one, accepts these terms for both of them and is responsible for the child’s use of TallPlan, including any meal photos or descriptions sent for analysis and any purchases.

You’re responsible for entering accurate information. Estimates and targets are only as good as the numbers behind them.

No sign-in account

TallPlan doesn’t have sign-in accounts, usernames or passwords. When you first open the app, it creates a random identifier and keeps it in your phone’s secure storage, where it can be synced or backed up through your Apple or Google account. We use it to link your subscription, to apply fair-use limits and blocks to meal analysis, and to find your case when you contact support. It doesn’t contain your name or contact details.

Not medical advice

TallPlan is an educational tool. It is not a medical device, and it doesn’t diagnose, treat, cure or prevent any condition. Nothing in TallPlan replaces a doctor, and you shouldn’t delay or skip medical care because of something it shows. In an emergency, contact your local emergency services.

The sleep and nutrition targets are general guidance for healthy people of your age and weight, based on the published sources listed under Health information in the app. If you have, or have had, an eating disorder, or a condition that affects what you can eat or how much you should sleep, talk to a doctor before following them. If you’re worried about your growth, or your child’s, see a doctor.

Estimates, not promises

Your predicted adult height is a statistical estimate with a range around it, not a guarantee. Real adult height can fall outside that range. The plan follows published guidance for a growing body, but no app, food or habit can promise extra height.

AI meal analysis

How it works

When you log a meal, you can take or pick a photo, or type a description. Before the first meal is sent, the app asks for your permission, and if you’re under 16, for confirmation that a parent or guardian agrees. After that, each photo or description you submit goes through our server to our AI provider, OpenAI, which estimates the meal’s protein, calcium and calories.

Along with the meal, we send only what’s needed to process the request: the random app identifier, your device’s language and technical data that protects our service from abuse. We don’t send your measurements, age, weight, or your answers about your body. Before a photo leaves your device, the app shrinks it and removes its location and other metadata. Our Privacy Policy explains how the data is handled and how long it is kept.

You can turn meal analysis off at any time in the app’s Settings. Meals you already logged stay on your device.

Your photos and descriptions

You keep all rights to the photos and descriptions you submit (“your content”). You give us and our AI provider a worldwide, non-exclusive, royalty-free permission to use your content only to analyze the meal, to run and protect the service, and as the law requires. We don’t use your content to advertise, and we don’t sell it.

When you submit content, you confirm that you have the right to share it, and that it’s about food and drink. Please don’t include people, faces, documents, screens, or anything that identifies you or someone else.

The results

The results are automated estimates and can be wrong. Portion sizes, hidden ingredients and preparation are hard to judge from a photo or a few words. Treat the numbers as approximate and fix them when they look off. The analysis can’t reliably identify ingredients or allergens, so don’t rely on it for allergies, intolerances or a medical diet. You may use the results for your own personal purposes.

Limits

Meal analysis needs an active subscription. To keep it working for everyone, we apply fair-use limits on how many meals can be analyzed in a period, and the app tells you when you reach one. We may refuse, limit or turn off meal analysis for anyone who breaks these terms, misuses the service, or submits content our AI provider’s usage policies don’t allow.

Subscriptions

Some features, including the height estimate and AI meal analysis, need an auto-renewing subscription. Subscriptions are sold and billed by the store you got TallPlan from (“the store”): Apple through your Apple ID on iPhone, or Google through your Google Play account on Android. The store’s terms apply to the payment. The price, billing period and any free trial are shown before you subscribe. Taxes may apply, depending on where you live.

  • Automatic renewal: your subscription renews automatically for the same period, and the store charges you for each new period, unless you cancel before the current one ends. On the App Store you’re charged within 24 hours before the current period ends, so cancel at least 24 hours before it ends.
  • Free trials: if a plan includes a free trial, it turns into a paid subscription when the trial ends, unless you cancel before that (on the App Store, at least 24 hours before). You can use a plan’s trial only once, as the store’s rules allow.
  • Cancelling: you can cancel anytime from Manage subscription in the app’s Settings, or in your Apple ID or Google Play subscription settings (the Support page links to both). You keep access until the end of the period you’ve paid for. Deleting the app, or using Delete data, does not cancel your subscription. We can’t cancel it for you.
  • Refunds: the store handles billing and refunds under its own terms. We can’t issue refunds ourselves; you can ask Apple at reportaproblem.apple.com, or Google as described in Google Play’s refund help. This doesn’t limit any refund or withdrawal right that the law in your country gives you.
  • Restoring: if you reinstall TallPlan or switch phones, sign in to the same Apple ID or Google account and use Restore purchase in the app’s Settings.
  • Price changes: we may change subscription prices. A change applies from your next renewal, and the store tells you about it in advance, and asks for your consent where its rules require it. If you don’t want to pay the new price, cancel before it takes effect.
  • Family Sharing: on the App Store, some plans can be shared with your family through Apple’s Family Sharing, as shown on the App Store.

Purchases made through Apple’s Ask to Buy, or on an account where Google Family Link requires a parent’s approval, need that approval before they complete.

Your data

Your measurements, logs, meals and answers about your body are stored on your device. TallPlan doesn’t sync them to our servers, so we can’t restore them if you lose your phone or delete the app. Copies inside your own device backups, such as iCloud, Google or computer backups, stay under your control.

Delete data in the app’s Settings erases everything TallPlan stores on your device except the random identifier, which your subscription is linked to, and clears the profile details our analytics and subscription providers hold for you. It doesn’t cancel your subscription, and it doesn’t erase what those providers have already received; our Privacy Policy explains what that is and how to ask us to delete it.

Acceptable use

When you use TallPlan, don’t:

  • break the law, or anyone’s rights, including privacy and intellectual property rights;
  • submit photos or text that aren’t about a meal, or that show other people, sexual, violent, hateful, threatening or harassing material, or anyone’s personal information;
  • upload malware or anything designed to harm TallPlan, our providers or other people;
  • try to get around the age check, the subscription, fair-use limits or any security measure;
  • access our server or AI features other than through the app, automate requests, or use TallPlan to build or train another product;
  • copy, modify, rent, lease, lend, resell, sublicense, decompile or reverse engineer the app, or remove its copyright or other notices, except where the law allows it;
  • interfere with or disrupt TallPlan, our servers or our providers’ systems;
  • use TallPlan to shame, rank or pressure anyone, especially young people, about their height, weight or body.

Suspension and ending

You can stop using TallPlan at any time by deleting the app. Remember to cancel your subscription in the store too.

If you break these terms, or we have to because of the law or our service providers, we may limit, suspend or end your access to TallPlan or to specific features, such as meal analysis. Where it’s reasonable, we’ll tell you first through the app or by email if we have your address. If we end access to a feature you’re paying for without a good reason, you can ask the store for a refund where the law or the store’s terms provide for one.

When your access ends, your license to use TallPlan ends too. Parts of these terms that by their nature should continue, such as those on intellectual property, disclaimers, limitation of liability and disputes, stay in effect.

Your feedback

If you send us ideas or suggestions about TallPlan, you give us a free, worldwide, perpetual permission to use them, without any obligation to you.

Intellectual property

TallPlan, including the app, the website, its design, text, graphics and the TallPlan name and logo, belongs to North Pattern LLC and its licensors and is protected by copyright, trademark and other laws. These terms don’t give you any right to use our name, logo or trademarks. Your content stays yours, as described in AI meal analysis.

Apple, the Apple logo, iPhone and App Store are trademarks of Apple Inc., registered in the U.S. and other countries. Google Play and the Google Play logo are trademarks of Google LLC. Other names may be trademarks of their owners.

License, Apple and Google

The app is licensed to you, not sold, for personal, non-commercial use on devices you own or control.

  • From the App Store: you may use it on Apple devices under the Usage Rules in the Apple Media Services Terms and Conditions, and Apple’s Standard End User License Agreement also applies. If it conflicts with these terms, these terms apply as far as the law and Apple allow.
  • From Google Play: you may use it on Android devices as the Google Play Terms of Service allow.

These terms are between you and us, not Apple or Google. We, not Apple or Google, are responsible for TallPlan, its content, its support, and any claims relating to it.

Third-party services

TallPlan relies on services run by others, such as Apple and Google for payments and OpenAI for meal analysis, and it may link to other websites. Their own terms and privacy policies apply to what they do, and we aren’t responsible for their websites or services beyond what these terms say. Our Privacy Policy lists the providers that receive data from TallPlan.

TallPlan is provided as is

We work to keep TallPlan accurate and available, but we provide it “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, to the extent the law allows. We don’t promise that TallPlan, its estimates or its meal analysis will be error-free, uninterrupted or secure, that every defect will be fixed, that data on your device won’t be lost, or that TallPlan will meet your goals.

Limitation of liability

To the extent the law allows, we and our suppliers aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, and our total liability for any claim related to TallPlan is limited to the greater of what you paid for TallPlan in the 12 months before the claim, or US$100.

These limits don’t apply to liability that can’t be limited by law, such as for death or personal injury caused by our negligence, or for fraud, gross negligence or willful misconduct. Some places don’t allow these limits, so they may not fully apply to you. Nothing in these terms takes away consumer rights that the law in your country says can’t be waived. If you live in the EU or the UK, we are responsible for foreseeable loss caused by our breach of these terms or our failure to use reasonable care.

Disputes and governing law

If something goes wrong, email us first at [email protected]. We’ll try to resolve it informally within 30 days.

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute that isn’t resolved informally will be decided by the state or federal courts located in Wyoming, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small claims court where it qualifies.

If you live in the European Union, the United Kingdom or another country whose law gives consumers mandatory protections, you keep them, including the right to bring a claim in the courts where you live.

Export and sanctions

You confirm that you aren’t located in a country subject to a US government embargo, and that you aren’t on any US government list of prohibited or restricted parties.

Changes

We may change, add or remove features, for example to improve TallPlan, fix problems or comply with the law, and we may stop offering TallPlan. Some updates may be needed to keep using it. We aren’t obliged to provide updates or support, though we intend to keep improving TallPlan. If a change significantly reduces what you’re paying for, you can cancel your subscription and ask the store for a refund where the law provides for one.

We may also update these terms. When we do, we’ll change the date at the top of this page. For significant changes, we’ll try to give you at least 30 days’ notice, in an app update or on this page, before they take effect, unless we have to change them sooner for legal or security reasons. If you keep using TallPlan after a change takes effect, the new terms apply. If you don’t agree, stop using TallPlan and cancel your subscription.

General

  • These terms and our Privacy Policy are the whole agreement between you and us about TallPlan.
  • If any part of these terms is found unenforceable, it will be applied as far as the law allows, and the rest stays in effect.
  • If we don’t enforce a part right away, we haven’t waived it.
  • You can’t transfer these terms to someone else. We may transfer them as part of a merger, acquisition or sale of TallPlan, without reducing your rights.
  • We may provide translations of these terms. If a translation conflicts with the English version, the English version applies, to the extent the law allows.
